The magistrate court wants to fine my mate £700 for a car he wasn't driving that isn't his!?
1. a car was caught speeding 2. my mate was in Australia 3. it's not his car! 4. my mate was acquitted of the speeding offence 5. the court has fined my mate £700 for not giving information on who was driving the car! 6. my mate appealed to the magistrates court 13 days BEFORE the 21 day deadline 7. the magistrates say he missed the 21 day deadline!!! 8. he now has to ASK the Crown court for permission to appeal the magistrate's court decison!
what gives? what can he do??
p.s. how the hell is my mate supposed to know who was driving the car???

if the magistrates court could not or would not process his appeal in time, that's one thing, but they keep saying that he MISSED the deadline
sometimes they can't even be bothered to sign their letters!

That's madness,how were they connecting him to the car? Did someone claim that the car was his?
Does he have documentation prooving he appealed within the deadline,because if he does the magistrate doesn't have a leg to stand on. If he doesn't he'll be hard pushed to get them to admit that the error is at their end.

Sorry Hatter. No offence. It's just that a good Lawyer could save him from the fine but would charge him much more for the service. In the end only the Lawyer would win.

Yup. And a Lawyer would cost so much more than that. Trust me on this - The Law dosn't work like you think it does. I may be silly about lots of things, but not this.

I suspect the DVLA (Driver and Vehicle Licensing Agency) said it was him. I wouldn't be surprised if it was someone else with the same name or they just have a mistake on their computer. I'm not sure if my mate knows the license plate number and even if he did, the DVLA wouldn't tell him anything anyway. I don't know why the court does not contact the DVLA to ask them to check the details again!?

the magistrates keep saying that it was outside the 21 days... they don't provide any evidence... they don't say if it was their fault or my mate's fault

You get in touch with a group dedicated to fighting naff fines. There will be one. Groups who oppose speeding cameras are VERY ACTIVE. They'll lawyer him up. He needs all the documentation to prove he was in Australia. He needs (as I suspect you haven't) to give ALL the circumstances of the fine imposed. Then he needs to do a search of the electoral rolls and find out approx how many people have the same name/ date of birth as he to show how easily this error could have been made.
Then show up in court and demonstrate how palpably ridiculous it is.

IF it goes to court?!1 He might just get a demand for £700 and if he doesn't pay then the police will arrest him. He works 6 days, 66 hours, a week and is trying to run a business

I agree with storm on this one. There has to be someone on the net who is willing to help. I think you just have to look. Either that or go to the TV networks and see if you can't get a Current Affair interested.
